This document sets out the terms and conditions for using the Crocoshop.ge website.
This document is a mutually binding agreement concluded between the user and Croco Shop LLC.
The terms and conditions for using the Crocoshop.ge website, together with any amendments made to them and other Crocoshop.ge regulations, constitute a single document and shall be regarded as a unified agreement concluded with the user.
When registering on the website, the user agrees to and acknowledges these terms and conditions, the privacy policy, and the return and exchange policy, and consents to be bound by their legal force.
For detailed information about the item return process and its rules, please review the item warranty, exchange, and return policy. The documents regulating the processing of personal data, the privacy policy, and the item return policy are an integral part of these terms and of the agreement between the parties, and are granted identical legal status.
Definitions
- Site - the website Crocoshop.ge.
- Company - the company that owns the website Crocoshop.ge, Croco Shop LLC (Limited Liability Company, ID: 445747041).
- User - a legal entity or a natural person aged 18 or over (legally capable) who wishes to purchase products listed on Crocoshop.ge;
- Registration - the creation of a personal account.
- Account - the personal page registered by the user on Crocoshop.ge.
- Products - any item offered for sale through the site.
- Third party - any natural or legal person, or public institution;
- Direct marketing - the direct and immediate provision of information to a data subject by telephone, mail, email, or other electronic means, for the purpose of forming, maintaining, realizing, or supporting interest in a natural and/or legal person, goods, ideas, services, work and/or undertaking, as well as image-related and social topics;
Registration
To purchase products on Crocoshop.ge, registration on the website is required, which involves completing the registration form with the following information:
- First name;
- Last name;
- Phone number;
- E-mail;
- Login password.
The user can register on the website during the purchase process and also before purchasing.
Registration/authorization before purchasing takes place after the user selects "Log in" from the website's main menu.
Merchant's obligations
- The merchant is obliged to deliver to the user goods that conform to the conditions stipulated by the contract.
- Goods are deemed to conform to the conditions stipulated by the contract if they correspond to the description provided by the merchant to the user and have the same qualities as the sample of the goods presented by the merchant to the user.
- In the absence of a description provided by the merchant to the user, the goods are deemed to conform to the conditions stipulated by the contract if they are fit for the purpose of which the user informed the merchant at the time of concluding the contract and to which the merchant agreed.
Statutory warranty
- If the goods turn out to be defective, the user has the right to demand that the merchant remedy the defect (repair or replace the goods free of charge, or reduce the price) or to withdraw from the contract.
- Repair and replacement of the goods are the user’s first-tier rights. The user has the right to demand that the merchant repair or replace the goods free of charge, except where this is impossible due to the nature of the goods or requires disproportionate or unreasonably high costs.
- The goods must be repaired or replaced within a reasonable period (replacement - no later than 10 calendar days from the discovery of the defect, and standard repair - no later than 30 calendar days from the discovery of the defect), so that the user does not experience significant inconvenience, taking into account the nature of the goods and the purpose for which they were purchased.
- Free repair or replacement of the goods means the merchant bears all costs (including postage, labor, and material costs) necessary to bring the goods into conformity with the conditions stipulated by the contract.
- The user has the right to demand a reduction in the price of the goods or to refuse the contract if one of the following conditions exists: repair or replacement of the goods is impossible; the merchant did not repair or replace the goods within a reasonable period and the user lost interest in performance of the contract; repair or replacement of the goods by the merchant would cause the user significant inconvenience.
- In the event of withdrawal from the contract, the user has the right to demand compensation for damage caused by non-performance of the contract in accordance with the procedure established by the legislation of Georgia.
- The user does not have the right to refuse the contract if the defect of the goods is insignificant.
- The user has the right to exercise the above rights if the defect of the goods is discovered within 2 years of the goods being handed over to them.
- If the user discovers the defect within 6 months of taking possession of the goods, it is presumed, until proven otherwise, that the defect existed at the time of delivery, where this is possible given the nature of the goods or the nature of the defect; in this case the burden of proof lies with the merchant. If the user discovers the defect more than 6 months after taking possession of the goods, the burden of proving that the defect existed at the time of delivery lies with the user.
Receiving an order
- The user can purchase an item by transferring funds to a bank account. It is also possible to pay the value of the item in cash to the courier.
- From the moment the funds are credited to the bank account, the merchant is obliged to process the user's order within no more than two days. The delivery time of the item to the user must not exceed 5 (five) working days from the processing of the order.
- The order is considered complete upon delivery of the item to the user.
- If it is impossible to deliver the item to the user, the order will be canceled and the client will be refunded the amount they paid.
- Upon receiving the order, the user is obliged to inspect it and confirm by signature that the item has no visual defects.
- On request, the merchant is obliged to hand over to the customer all documents related to the order.
Delivery is free throughout Georgia.
